1. SCOPE OF APPLICATION

SHOP.PARADELTA.CH is a site specialized in the mail order sale of paragliding equipment, accessories, textiles and other derivative products. These conditions apply to the sale of products or services on the SHOP.PARADELTA.CH website.

SHOP.PARADELTA is a registered trademark and belongs to the company Aerodyne Concept SA, whose head office is located in Troinex and registered in the Geneva commercial register under the number CHE-114.820.895

2. ORDER

Orders will not be validated until payment has been accepted by the online payment organization or upon receipt of payment by bank transfer. If the payment has any anomaly, the order will be automatically canceled.

Any incomplete or incorrect order will not be taken into account. Any order older than 1 month and for which we have not received a valid payment will be automatically canceled.

SHOP.PARADELTA reserves the right to modify the products sold in the shop, their prices, their delivery time, their technical characteristics except for orders actually placed on the site before the modification.

SHOP.PARADELTA reserves the right to cancel or refuse any order from a customer with whom there is a dispute over payment of a previous order.

3. PRICE

The prices of our products are indicated in euros or CHF all taxes included, excluding participation in processing and shipping costs.

For all products sold in our territory for another country, the price will be calculated all taxes included automatically on the invoice. Customs duties or other local taxes or import duties or state taxes may be payable. These rights and sums are not the responsibility of SHOP.PARADELTA.

They will be your responsibility and are your full responsibility both in terms of declarations and payments to the competent authorities and / bodies in your country. We advise you to find out about these aspects from your local authorities.

All orders regardless of their origin are payable CHF.

SHOP.PARADELTA reserves the right to modify its prices at any time but the products will be invoiced on the basis of the prices in force at the time of the registration of orders, subject to availability on this date.

4. SHIPPING COSTS

Shipping costs are calculated based on weight, carrier and destination: shipping costs are calculated at the end of the basket.

5. VALIDATION

Unless proven otherwise, the data recorded by SHOP.PARADELTA constitutes proof of all transactions made by SHOP.PARADELTA and its customers.

SHOP.PARADELTA reserves the right to refuse or cancel a transaction which does not correspond to the ethics of the company, if the price presents a manifest error, the security of payment of which is not assured or the material adequacy of which driver would not be certain.

However, the customer remains fully responsible for his choice of material, SHOP.PARADELTA can not be held responsible for a poor match between the material and the level or practice of the customer and this especially in the case of a purchase direct to the online store.

6. AVAILABILITY

All the products presented on this site are available on average within 4 to 10 working days for products in stock and within 5 to 30 working days for products in restocking (after acceptance of payment).

In the event of unavailability within more than 30 working days after the period announced during the order, the customer may cancel all or part of his order and he will then be reimbursed within 15 working days. Certain products may require a delay of more than 30 days (in particular in the case of custom-made products, breakage of parts at the manufacturer).

In the event that the manufacturer has decided to stop manufacturing the ordered product, SHOP.PARADELTA undertakes to reimburse it as soon as we have this information. SHOP.PARADELTA can not be held responsible for any damage suffered by the customer insofar as this decision is not our fault.

7. WARRANTY & CONFORMITY

All new products in the store are guaranteed for at least 1 year by their manufacturer, unless the manufacturer has special conditions.

Guaranteed products must be sent at the buyer's expense to an approved technical station. Please note, some manufacturers only guarantee parts and you will therefore have to pay for labor and travel.

Any product damaged by improper use will not be guaranteed. If the product is immobilized for more than 7 days, the manufacturer's or optional warranty will be extended for the duration equivalent to that of the immobilization.

In accordance with the Consumer Code, the consumer has a period of 7 working days from the date of delivery of his order to return any item that does not suit him and request the exchange or refund without penalty, at the except return costs. This right of return can only be accepted for complete products, in their original packaging, complete (accessories, instructions), in good condition and accompanied by a copy of the purchase invoice. Items returned incomplete, damaged, damaged or soiled by the Customer are not accepted.

Products that are not part of the assortment tracked in store by SHOP.PARADELTA and products specially ordered for the customer will not be returned or exchanged, unless special arrangement found with the manufacturer of the product.

In case of exercise of the right of withdrawal, SHOP.PARADELTA is required to reimburse the sums paid by the customer, free of charge, except for return costs. The refund is due within a maximum of 15 days. In the case of used products, sold on behalf of pilots (consignment store), the shipping costs are not reimbursed.

In case of cancellation of an order paid by CB in three installments, financial costs will be retained up to 2% of the order with a minimum of 20 €.

Regardless of the manufacturer's warranty, the seller remains liable for any lack of conformity of the goods with the contract and unacceptable defects under the conditions provided for in the Civil Code.

Used products are sold in the condition described by SHOP.PARADELTA, see quality control on the invoice. If the condition of the used product (s) sold does not correspond to the description, the customer has 7 days to return them by tracked parcel.

SHOP.PARADELTA cannot be held responsible in the event of loss or deterioration of the equipment during the return transport of the products.

8. LIABILITY

The products offered comply with current Swiss legislation and the standards applicable in Switzerland. SHOP.PARADELTA cannot be held liable in the event of non-compliance with the legislation of the country where the product is delivered (for example in the event of a product being banned).

It is your responsibility to check with local authorities the possibilities of importing or using the products or services that you plan to order.

The use of the products purchased is under the responsibility of the buyer. SHOP.PARADELTA declines all responsibility, in particular for direct or indirect damage suffered by the buyer or a third party following the use of the product. Outside the legal framework, SHOP.PARADELTA declines all responsibility in the event of direct or indirect damage suffered by the buyer or a third party due to a defect in the product.

9. DELIVERY

The products are delivered to the delivery address that you indicated during the ordering process. The times indicated are the usual average times.

In the event of items deliverable on different dates, taking into account their availability, the delivery time is based on the longest time SHOP.PARADELTA reserves the right, however, to split deliveries. The participation in processing and shipping costs will only be invoiced for one shipment. SHOP.PARADELTA cannot be held responsible for the consequences due to a delay in delivery.

For shipments abroad, in the event of an address error on the part of the customer or failure to collect the package, the return transport costs will be borne by the customer. In case of loss of the package due to an address error, SHOP.PARADELTA will not be responsible and therefore will not reimburse.

10. DELIVERY PROBLEMS

You must notify the carrier and SHOP.PARADELTA of any reservations about the product delivered (for example: damaged package, already open ...) within 2 days of receipt of the product. SHOP.PARADELTA is released from its delivery obligation for all fortuitous events or force majeure (total or partial strikes, floods, fires ...).
